U.S. auto insurance practices might hurt low-income earners: report

Using a survey conducted by market research firm ORC International, the CFA said about two-thirds of Americans think the use of education and occupation to set insurance rates is unfair.

Auto insurance is required to own and operate a vehicle in all U.S. states except New Hampshire.

Progressive Corp., which had the second-highest difference in premiums, was found to charge the factory worker 33 percent more in Baltimore and 8 percent more in Oakland, California.

However, Robert Hartwig, an economist and president of the Insurance Information Institute, an industry group representing insurance companies, said dozens of factors go into determining insurance rates, each correlating with risk.

The CFA plugged information about a fictional person into each company's website to get a quote, changing only education level and occupation to see the effect on rates. Five of the insurance companies were found to collect such information.

Hartwig also said the use of so many different models was a sign of a competitive market. A market in which all companies used the same variables would result in uniform pricing, he said.


Hartwig defended the use of correlation, saying it was what insurers and actuaries typically use because causation might never be known.

"The quoted prices, especially the nine exceeding $2000, show that insurers either are overcharging lower-income consumers or are not interested in serving them," Bob Hunter, the CFA's director of insurance, said in a statement.

Insurance regulation is usually at the state level. But Stephen Brobeck, executive director at the CFA, suggested it is not a big enough concern for state officials and said he hoped attention from consumer advocacy groups would change that.

Factors such as age, gender and credit ratings are also used because they have been found to correlate with the frequency or size of claims, according to the III's website.

The organization said the Federal Insurance Office, an agency born out of the 2010 Dodd-Frank financial regulatory reform law, might be able to change how insurers determine rates.

Common practices that the CFA agreed should be used for setting rates include a person's past driving record and miles driven. Location and type of car are also often used because they can increase the cost of a claim.

The report, released on Monday, looked at premiums set by the 10 largest auto insurance companies in 10 urban areas across the United States.

"Why would an insurer collect data that is not useful?" Hartwig asked. "These factors are used for one reason and one reason only, and that's to ascertain risk."

Since education and occupation have been found to correlate with race, the CFA said the practice of using such factors is discriminatory.

He added that the CFA also opposes the use of credit ratings because it discriminates against low-income earners.

Officials at Travelers were not immediately available to comment.

But the CFA said that while such factors may indicate correlation, they do not necessarily indicate causation.

The report found that Geico, part of the Berkshire Hathaway group of companies, charges more in six of the analyzed markets for a factory worker with a high school diploma than for a factory supervisor with a college degree. The rate could be as much as 45 percent more in Seattle or as low as 20 percent more in Baltimore.

Village of Oakley eyes self-insurance as July 1 insurance cutoff now weeks away

Clerk Cheryl Bolf told the group of about 30 residents in attendance that the village has not secured an insurance plan, but she is working with attorneys to find a solution.

OAKLEY, MI -- With less than a month until its liability and property insurance is set to expire, the village of Oakley is trying to secure coverage or decide what to do if the date comes to pass.

The issue was complicated because Village President Doug Shindorf was not at the meeting. He has been at Sparrow Hospital in Lansing fighting his own battle after he was diagnosed with leukemia in May.

Another resident, Cozy Milbrant, asked why Dennis Bitterman can sue the village and said she believes it is a "conflict of interest" for him to do so. Bitterman is on the Village Council.

The June 10 meeting began with a 15-minute argument between resident Elaine Perkins and board member John Lorencz about who should be cutting grass. Perkins complained that Lorencz informed her husband, Kenny Perkins, the village's public works employee, that Lorencz would take on the duty.

The Michigan Municipal League cited both items as reasons for the insurance cut-off in an email sent to The Saginaw News in May:

"How come someone is not being held accountable?"

Elaine Perkins complained that her husband has been cutting the grass for years and that it is not a board member's job to instruct village employees.

The board heard complaints and questions about how the village is operating while facing the impending cut-off and what will happen if they can't find insurance by the July 1 deadline.

Self insurance "wouldn't cost us anything" unless something happens that requires the village to pay for it, including the cost to defend the village against any future lawsuits. 

It is one of many small issues the village is dealing with as it looks to save money and continue operations with the expected insurance shut-off.

Those costs would come out of the taxpayer-funded village budget, she said.

It's a story The Saginaw News broke in late March in a series called "Small Town, Big Problem."

Village President Pro Tem Sue Dingo explained that when attorneys advised village officials they could not allow people to work for free, they changed their stance on the issue.

"There's just no answer," Dingo said. "If you think that's hard on you, you should be up there with us."

She has been in discussions with attorneys about how self-insurance would operate but said the village would be responsible for anything that happens related to village equipment or personnel. She said the village will have worker's compensation coverage.

"Maybe they'll paint the Village Hall," he laughed when asked if there was anything the officers could do without insurance coverage.

"I was told the reasons were because lawsuits and because Chief (Robert) Reznick did not comply with who he needed to, to be insured," he said. "I still haven't gotten an answer, for him not doing that we lost our insurance? True or not? That's true.

Bolf explained that Reznick was not informed by the Michigan Municipal League that he was not in compliance before the league sent a notice that the village would lose insurance coverage July 1. 

In a past interview, Shindorf said police officers may have to "sit in the village office" because they won't be able to patrol the village without liability insurance coverage.

Since 7-1-2010, the Village has incurred seven claims and the Pool has incurred $4.51 for every dollar of premium paid to the Pool. Five of these claims occurred in policy year 2012 and four of the five were under the coverage of Public Officials Liability (wrongful acts).

The decision to non-renew the Village of Oakley was an underwriting decision based on the Village's claim frequency and the Village of Oakley Police Department's lack of cooperation and commitment with MML Liability & Property Pool risk management efforts.

Bolf argued that the village is losing its insurance because of lawsuits levied against the village and its officials. 

Resident Reynaldo Rodriguez, 44, said he has asked why the village lost its insurance at the past meetings and still is not satisfied with the answer after asking about again at this week's meeting. 

"Kenny's got his job back," Dingo said.

Reznick told The Saginaw News in a past interview that someone from the Michigan Municipal League told him in 2008 the agency was not a fan of the idea of a large police reserve force. Reznick claims he had not heard from the agency until it sent a notice of insurance non-renewal in 2014.

"If anything happens, the village has to pay for it," Bolf said. "We have no options. We have no insurance. What should we do?"

Lorencz said Shindorf told him he could cut the grass if he volunteered without pay. Other board members have since learned the village cannot operate that way. 

"We'll be self-insured by then," she said, adding she is working with attorneys to develop a form that could be signed for people wishing to rent the Village Hall that would relinquish the village from liability in case of incident or injury. 

She said Reznick was not able to meet with someone from the league who requested a meeting in the past, and that was the only time he may not have been in compliance. 

If the village cannot find an insurance carrier that will take it on, its only option will be to self-insure, Bolf said.

After an explanation, Dingo said Perkins should continue to cut the grass and Lorencz should relinquish the job.

Answering a question about what will happen July 1 if the village has no insurance, Bolf said, "the village keeps on going."

Bankrate found that 10 major car insurance carriers provided a discount for having multiple policies with that carrier. Eight of the 10 major insurers charge less for paperless billing.

Not all the discounts are clearly advertised, some of which can be found in question-and-answer sections or blog posts, said Whiteman. Some discounts are particular to certain states or by location. For example, some carriers offer discounts to young drivers attending school at least 100 miles from home, which is known as a distant student discount.

And there are even more discounts that Bankrate did not track, Whiteman said. Some carriers might have discounts for new parents, or those who own a home.

"It's a really good idea on a regular basis to review your car insurance policy, maybe at renewal time," Whiteman said. "Some companies better at advertising discounts than others. In some case you have to talk to someone on the phone."

Car insurance companies are aggressive in boasting about their discounted rates, but which ones offer the most?

Bankrate.com put together a list of 17 discounts that car companies offer, such as a discount for having an anti-theft device for your car or being a member of the U.S. military. Of the 10 companies studied, Farmers offered the highest number of discounts at 16.

"The idea is  if your kid is away from school, he or she is much less likely to be driving the family car, so you can get a break on your insurance," Whiteman said.

This can prevent you from taking unnecessary chances with your car, such as allowing a friend to drive it, filing for uncovered damages -- or worse -- filing too late. The last thing you want is to file and then be denied because you waited too long.

Never let another driver talk you into not calling the police at the scene of an accident. Once you've contacted the police, all parties involved should wait until they've been interviewed, and until the authorities have cleared them to leave. If for some reason you didn't call the police, and you plan to make a claim on your insurance, you must file a report as soon as possible, make copies and send one to your adjuster. Not having a report will hold up your claim. Also, if you didn't file a claim right away, it may raise questions with your carrier.

You should file the paperwork provided on your insurance carrier's website as soon as possible. "Even the largest national insurance companies have limited awareness," said Jeremy Bowler, senior director of the insurance practice at J.D. Power. "Some of the big carriers may be well-known in one city or province, but have little or no awareness outside of that market. To grow their business, they need to build brand awareness, which traditionally requires significant advertising investment."

At first, I was going to apply $250 of my subsidy credit and have a premium of $345 - but I later called back to change it and use the entire $286 subsidy, making my premium $309.

Meanwhile, I tried to get my medication, and the pharmacy told me I'm not covered. I called BCBS and they were able to get the pharmacy to supply my medication. But one month later, I am back where I started - BCBS says I never paid them the $345 I don't owe, and the pharmacy doesn't think I'm covered.

As for other consumers who qualify for health insurance subsidies available to people with incomes at 100 to 400 percent of the federal poverty level (currently $11,490 to $45,960 for an individual), whether you want to use your entire subsidy up front may depend on what you expect your income to be this year. If you earn more money than expected, you may have to repay some of the subsidy at tax time.

Everything seemed all right until I received a billing statement saying I owe $345. I called, and the BCBS rep told me to just send a check for $309 and attach a note explaining that I decided to use my whole subsidy. I did that, and BCBS cashed my check.

Should I Buy Gap Insurance If I Lease a Car?

In many leases, gap insurance is built into the contract, so check your agreement carefully to determine whether it is included in yours. Keep in mind the term "gap insurance" may not be used in the contract, and a more general term such as "lease coverage" might be used instead.

Keep in mind that the "gap" is constantly fluctuating as you make your monthly payments and as the car depreciates. So you definitely won't need the coverage for your entire lease period. You may only need it for a few months, depending on how good a deal you negotiated.

If you don't have gap insurance coverage built into your car lease contract, then you may want to add it to your current auto insurance policy or purchase it separately. A general rule of thumb is that a car loses about 10 percent of its Manufacturer's Suggested Retail Price the moment you drive it off the lot. So compare your total cost -- including taxes and everything you rolled into the lease -- to the car's MSRP, and see if you have a "gap" from the start.

By rolling all the costs associated with the car into the monthly lease payment, it is certainly possible that you would owe more than the car was worth if you experienced a total loss soon after your lease began. Gap insurance -- insurance which bridges the gap between what a car is worth and what you owe at the time of the loss -- would provide you the protection you are seeking. Bad credit can almost double your car insurance premiums

"About 40% of every consumer's bottom line score will be driven primarily by whether or not you paid your credit obligations on time," said Larmont Boyd of Fair Issac Corporation says on credit-based insurance rates.

And drivers with median credit scores were found to pay 24% more, the report found.

Insurers assess drivers using a special scoring model that is different than the one mortgage lender use. Instead of looking at your ability to repay a debt, this score aims to predict your likelihood of incurring future insurance losses, explained Laura Adams, an analyst at InsuranceQuotes.com.

Basing car insurance rates off of credit scores is a controversial practice. Opponents say credit-based insurance rates are unfair because they largely and negatively affect low-income drivers. However, supporters say the scores benefit those with good credit.

A 2005 report from the Government Accountability Office found that a majority of Americans did not know their credit score could impact their insurance rates.

Credit scores are one of many factors that insurers use to determine a driver's premiums. Other variables include age, gender, driving records and past insurance claims.

California, Massachusetts and Hawaii have banned insurers from using credits scores to determine rates.

Based on data from six large insurers from across the United States, InsuranceQuotes.com found that drivers with poor credit pay as much as 91% more than people with top credit scores.

Like regular credit scores, the insurance score is based on reports from credit bureaus and still takes into account things like late payments, outstanding debt, bankruptcies and new applications for credit.

"Responsible habits, such as paying your bills on time and minimizing debt, pay off in many ways, including paying less for car insurance," said Adams.
